Welcome to FxSVPS. These Terms & Conditions (“Terms”) govern your access to and use of the FxSVPS website, services, and products (“Services”). By placing an order, creating an account, or using any FxSVPS Services, you agree to be bound by these Terms.

Important: FxSVPS provides VPS hosting and infrastructure services only. We do not offer trading, brokerage, investment, or financial advisory services. Any trading decisions and risks remain solely with the user.

1. Definitions

  • “Customer/You” means the person or entity purchasing or using the Services.
  • “VPS” means a virtual private server provisioned by FxSVPS.
  • “Account” means your FxSVPS customer area/WHMCS account.
  • “Service Activation” means the point at which the VPS is provisioned and credentials are issued.

2. Eligibility & Account Information

  • You must provide accurate contact and billing details and keep them updated.
  • We may request identity or business verification to prevent fraud and reduce disputes.
  • You are responsible for maintaining the confidentiality of your login credentials.

3. Services & Provisioning

  • Services are delivered digitally. VPS access details are provided after successful payment and activation.
  • Provisioning time may vary based on verification, inventory, or technical conditions.
  • We reserve the right to refuse service to prevent fraud, abuse, or policy violations.

4. Acceptable Use Policy (AUP)

You agree not to use our Services for illegal, harmful, or abusive activities. Prohibited activities include, but are not limited to:

  • Spam, phishing, malware, botnets, DDoS attacks, or any unauthorized access attempts
  • Card testing, payment fraud, stolen credentials, or any fraudulent behavior
  • Hosting or distributing illegal content, copyrighted content without permission, or prohibited material
  • Cryptomining (unless explicitly permitted in your plan), excessive resource abuse, or disruptive activity
  • Activities that violate the policies of our upstream providers or datacenters

Violations may result in suspension or termination without notice where required to protect our network, customers, or payment partners.

5. Payments, Billing & Renewals

  • All fees are listed on our website/order form and are payable in advance unless otherwise stated.
  • Recurring services renew automatically unless cancelled prior to the renewal date.
  • Failure to pay may result in service suspension or termination.
  • Prices may change with prior notice; existing subscriptions may be updated on renewal.
  • Customers are responsible for reviewing all invoices and billing details upon receipt.
  • Any billing-related concerns, discrepancies, or disputes must be reported within 7 days of the transaction or invoice date.
  • Requests raised after this period may not be eligible for review, adjustment, or refund due to limitations in historical data availability and system records.

6. Refunds

  • Refunds are governed by our Refund Policy and are only issued in eligible cases at our sole discretion, unless otherwise required by law.
  • Where applicable, refunds may be provided either as account credit or returned to the original payment method, subject to payment processor rules and our internal review.
  • Any billing-related concern, overpayment claim, or refund request must be reported within 7 days of the transaction or invoice date.
  • Requests submitted after this period may not be eligible for review, adjustment, or refund due to limitations in historical billing records, system data availability, and verification constraints.
  • Refunds will not be provided for services already delivered, partially used subscription periods, voluntary cancellations after renewal, setup fees, software/license fees, third-party add-ons, or any charges clearly disclosed at the time of purchase, unless otherwise stated.
  • If a refund is approved, processing times may vary depending on the original payment method and payment provider.
  • Where a direct refund is not possible or not appropriate, we may offer a non-expiring account credit for future use.

7. Chargebacks & Disputes

  • If you believe there is a billing issue, you agree to contact our support team first and allow us a reasonable opportunity to investigate and resolve the matter before initiating a chargeback or payment dispute.
  • Initiating a chargeback or payment dispute for a charge that is valid, previously explained, or not first reported to us within the required time period may be treated as a violation of these Terms.
  • Unauthorized, abusive, or fraudulent chargebacks/disputes may result in immediate service suspension, account limitation, or permanent account termination.
  • In the event of a dispute, we may provide relevant evidence to the payment processor or financial institution, including invoices, order records, login/access logs, provisioning records, communication history, and service usage records.
  • Any reversed amounts, dispute fees, chargeback fees, and related administrative costs may be added to the client’s outstanding balance where permitted.
  • Accounts with an active chargeback or unresolved payment dispute may be restricted from placing new orders or renewing existing services until the matter is fully resolved.

8. Service Limitations & No Profit Guarantee

FxSVPS provides technical infrastructure only. We do not guarantee profits, trading outcomes, or financial results. Any references to “Forex” on our site relate to typical use cases by traders and do not imply financial services.

9. Uptime, Maintenance & Support

  • Scheduled maintenance may occur and may temporarily affect service availability.
  • We provide support through our ticketing system and published support channels.
  • We may apply security updates or patches to protect infrastructure and customers.

10. Customer Responsibilities

  • You are responsible for software installed on your VPS and its configuration/security.
  • You must maintain backups of your data. We recommend regular off-site backups.
  • You are responsible for compliance with all laws applicable to your use of the Services.

11. Suspension & Termination

  • We may suspend or terminate Services for non-payment, fraud risk, or AUP violations.
  • We may terminate accounts that present elevated dispute risk to protect our payment partners.
  • Upon termination, access may be revoked and data may be deleted after a reasonable retention period.

12. Privacy

Our handling of personal data is described in our Privacy Policy. By using our Services, you consent to the collection and processing of information as described there.

13. Limitation of Liability

To the maximum extent permitted by law, FxSVPS and its operators shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use of the Services.

14. Disclaimer of Warranties

Services are provided on an “as-is” and “as-available” basis. We disclaim all warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Governing Law

These Terms shall be governed by the laws applicable to the operating entity, without regard to conflict of law principles. Any disputes shall be handled in the appropriate jurisdiction where permitted.

16. Changes to These Terms

We may update these Terms from time to time. The latest version will always be posted on this page with an updated effective date. Continued use of the Services constitutes acceptance of the updated Terms.
